Description

Purchase a 1/2 a sheet of ice for personal exercise. Limited to a household of 5. The ice will be purchased as is as we will not be able to resurface the ice surface.

“THE ICE HOUSE”

ICE RENTAL CONTRACT

The undersigned hereby agrees to pay the Fogerty Ice Arena, Inc. (hereafter referred to as The Ice Arena) as and for the rental of the ice surface and facilities incidental thereto at the following dates and times, the sum of $130.12, which is payable upon demand but in no event later than the last day of use.

• We can only rent to no more than 2 households with a max of 5 people.
• If there is a clear distinction that there are multiple households arriving at the facility you will not be allowed on the ice and NO REFUND will be given.
• NO intermixing of with the household on the other half of the rink.If intermixing happens you will be asked to leave with NO REFUND will be given.  
   
• We allowed to sell ice time to no more than two households
• Household is considered no more 5 people
• MASKS must be worn at all times within the facility
• NO organized practices strictly for recreational purposes
• All members of a household should social distance 6ft while on the ice surface.
• The entire household has to be on the ice.
• No Spectators
• Locker Rooms are closed.
• Household will have 10 minutes to enter the facility
• Household will have 10 minutes to leave the facility
• If we determine that there are individuals from multiple households you will not be allowed to skate and NO refund will be given.
• NO Scrimmage and games are allowed at Fogerty Arena
• Social distancing practices must be practiced while in the facility.

The undersigned hereby agrees it and its members using the said facilities of The Ice Arena will abide by all rules and regulations from time to time in effect governing the use thereof.

ASSUMPTION OF RISK: Licensee, and all persons using the ice surface, for any purpose, under this Agreement, and all invitees of Licensee, including the potential for possible exposure to illness from infectious diseases including but not limited to MRSA, influenza and COVID-19, assume all risk and danger incidental to ice skating in general, and the game of hockey in particular. These risks and dangers include, but are not limited to, the danger of being injured by pucks, hockey sticks and players.

POLICES AND PROCEDURES: Lessee providing services will be required to provide Lessor a copy their organization Policies and Procedures on how Lessee will handle new social distancing guidelines on and off the ice, dealing with spectators and if an outbreak of COVID-19 occurs. Lessor will not be approving any policy or procedure plan, as Lessor only wants a copy on hand to answers to any question that may arise from Lessee patrons.

WAIVERS: Lessee not providing services will need to provide all participants skating with a waiver. An online link or a physical copy will be provided to Lessee to distribute to its skaters.

RELEASE: Licensee hereby releases and discharges Licensor from any claims that it may have arising out of the use of Arena pursuant to this Agreement.

HOLD HARMLESS: Licensee will indemnify, defend and hold harmless Licensor, its officers, agents and employees from any claim caused by Licensee's negligence.

It is understood that the Ice Arena reserves the right (1) to cancel this agreement for any default by the undersigned in the terms of this agreement, and (2) to reschedule the dates of times of permitted use of said facilities, for just cause, on five days’ notice to the undersigned. FAILURE TO APPEAR OR CANCELLATION OF ICE TIME SHALL RESULT IN FORFEITURE OF DEPOSIT FOR THAT DATE. THE ICE ARENA RESERVES THE RIGHT TO DEMAND AND RECEIVE FULL COM-PENSATION FOR THE UNUSED RESERVED TIME.

The Ice Arena shall not be held responsible for the cancellation of ice time for reasons beyond the control of the Ice Arena, its agents or employees, such as but not limited to equipment failure, loss of power, severe weather or acts of God. In the event of such an occurrence, the Arena Manager will attempt to reschedule the organization’s rental time or the organization may cancel and receive a return of its deposit.
